The following terms supplement, and not replace, Apple Media Services Terms and Conditions (and the "Standard EULA" defined within it). If you do not accept these additional terms, please do not download or use the Erol Singer's Studio app.
Always consult a physician before starting a voice training program, including the exercises contained within this application. If you notice any physical discomfort in your throat or other body part(s), while performing, or after performing, the lessons included within this application, or the techniques it teaches, stop using the application and the techniques it teaches immediately and consult a physician. Singing should never hurt; if you continue practicing or singing while you feel discomfort, you risk serious injury to your vocal cords, throat, and other body parts.
VOICE TRAINING INVOLVES THE RISK OF PHYSICAL INJURY, AND BY USING THIS APPLICATION, YOU ASSUME ALL RISKS ASSOCIATED WITH YOUR USE OF THE APPLICATION. YOU AGREE TO WAIVE ANY AND ALL CLAIMS AND TO RELEASE EROL STUDIOS INC., ITS DIRECTORS, OFFICERS, AGENTS, EMPLOYEES, INDEPENDENT CONTRACTORS, SUBCONTRACTORS, AFFILIATES, REPRESENTATIVES, SHAREHOLDERS, AND SUCCESSORS (HEREINAFTER COLLECTIVELY REFERRED TO AS “EROL STUDIOS”) FROM ANY AND ALL LIABILITY FOR ANY INJURY, EXPENSE, LOSS, OR DAMAGE, INCLUDING THE FORMATION OF ANY BAD OR HARMFUL SINGING HABITS, THAT YOU MAY SUFFER. YOU FURTHER AGREE TO INDEMNIFY AND HOLD HARMLESS EROL STUDIOS FROM ALL LIABILITIES AND/OR CLAIMS FOR INJURY AND/OR OTHER DAMAGES TO ANY THIRD PARTY, ARISING FROM THEIR USE OF YOUR COPY OF THIS APPLICATION AND/OR THE INFORMATION IT CONTAINS. YOU ARE RESPONSIBLE FOR INFORMING THEM OF THE RISKS DESCRIBED WITHIN THIS AGREEMENT.
THIS APPLICATION SHOULD BE USED AS A SUPPLEMENT TO, NOT A REPLACEMENT FOR, VOICE LESSONS BY A PROFESSIONAL VOICE TEACHER. IN NO EVENT SHALL EROL STUDIOS BE LIABLE TO YOU FOR THE ACCURACY, COMPLETENESS, CORRECTNESS, TIMELINESS, USEFULNESS, OR FITNESS FOR A PARTICULAR PURPOSE, OF ANY INFORMATION, PRODUCTS, SERVICES, OR OTHER MATERIALS PROVIDED VIA THIS APPLICATION, OR IN RELATIONSHIP TO IT (INCLUDING HELP DOCUMENTATION, SUPPORT EMAILS, AND FORUM MESSAGES).
This Supplemental Terms of Agreement and any rights, duties and obligations as between the parties to this Supplemental Terms of Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of British Columbia, Canada, and no other jurisdiction. Any litigation involving Erol Studios shall be brought solely within the Province of British Columbia, Canada, and shall be within the exclusive jurisdiction of the Courts of the Province of British Columbia, Canada, unless the litigation involves Apple Inc. as a key party, in which case the “Apple Media Services Terms and Conditions” agreement takes precedence.
